Key points

  • You need a Portuguese tax number (NIF) to pay municipal fees and register the pool for IMI; if you bought your property in Portugal, you already have one.
  • Since Decree-Law 44/2022, non-residents who sign up to the tax authority's electronic notifications are exempt from having to appoint a fiscal representative (article 19 of the General Tax Law).
  • Pool construction in Portugal pays the standard 23 % VAT (IVA): the reduced 6 % rate for home building works expressly excludes pools.
  • A pool adds 0.06 to the IMI quality-and-comfort coefficient — roughly €40–€60 more property tax a year on a typical villa — and must be declared within 60 days of completion.
  • To swim by summer, ask for quotes between September and January: a concrete pool needs 8–12 weeks on site plus 3–6 weeks for design and the prior notice.

How does building a pool in Portugal work if you live abroad?

Building a pool in Portugal from abroad follows the same steps as for a resident: a project study, a design, a prior notice (comunicação prévia) to the câmara and 8–12 weeks of works. The differences are paperwork — a NIF and a power of attorney (procuração) — and following the build by video call and weekly photo reports.

With Pools Portugal, the pool itself is built by experts from the Pools Portugal Network, vetted builders chosen for your type of pool and ground. Pools Portugal is your single point of contact, in English or Portuguese, from the first call to the first swim, and our own team handles start-up and maintenance afterwards. The full process is in the pool construction guide.

  1. 1

    Check your paperwork

A NIF (you already have one if you bought property here), ideally a Portuguese bank account, and a power of attorney so the responsible technician can deal with the câmara for you.

  2. 2

    Free project study

A site visit or video call: measurements, access, ground, plant-room position and a reference budget. We also check whether your plot needs a prior notice or a licence.

  3. 3

    Design and fixed quote

A Network expert defines the build method and equipment; you receive an itemised quote with payments tied to completed stages.

  4. 4

    Prior notice to the câmara

The responsible technician files the prior notice, the fees are paid and the start of works is notified. See the permits guide.

  5. 5

    Build, followed remotely

Weekly reports with photos, and video calls for the decisions that matter.

  6. 6

    Start-up and maintenance

Our team fills the pool, balances the water, sets up the equipment and then looks after it while you are away.

Do you need a NIF, a fiscal representative and a Portuguese bank account?

You need a NIF (Portuguese tax number): it is free and required to pay municipal fees and declare the pool for IMI. Since Decree-Law 44/2022, non-residents who sign up to the Portal das Finanças electronic notifications do not have to appoint a fiscal representative. A Portuguese bank account is not a legal requirement, but makes paying in euros simpler.

ItemDo you need it?How to get it
NIF (tax number)Yes — to pay fees and declare the pool for IMIFree. In person at a tax office (Finanças), or online through a representative via the e-balcão if you live outside the EU/EEA
Fiscal representativeNot if you sign up to electronic notificationsSign up to notifications on the Portal das Finanças; otherwise appoint a representative resident in Portugal
Portuguese bank accountNot legally requiredBanks set their own requirements: typically NIF, passport and proof of address
Power of attorney (procuração)Recommended if you are not in PortugalSigned before a notary abroad with an Apostille, or at a Portuguese consulate

Sources: gov.pt guide to NIF for foreign citizens (updated 2 Sep 2026); Portuguese Tax Authority note on Decree-Law 44/2022; DECO PROteste on the Hague Apostille.

Official sources do not all say the same thing. The gov.pt guide (updated September 2026) still lists a fiscal representative resident in Portugal when a non-resident applies for a NIF, while the tax authority confirms that Decree-Law 44/2022 waives the obligation for anyone who signs up to electronic notifications. In practice, you may need a representative to obtain the NIF and can then switch to electronic notifications. Confirm with Finanças before you apply.

Do you need to be in Portugal to get the permit?

No. A pool attached to a house needs a prior notice (comunicação prévia), filed by the architect or responsible technician, who can sign and submit for you with a power of attorney (procuração). A procuração signed abroad needs an Apostille under the 1961 Hague Convention, which the UK, Germany, France, the Netherlands and the US have all joined.

The Apostille is issued by the competent authority of the country where the document was signed, not by the Portuguese consulate; a document not in Portuguese usually also needs a certified translation. Alternatively, you can sign the procuração at a Portuguese consulate — check with the consulate first. Since 1 October 2026, works can start as soon as the prior notice is filed, the fees paid and the start of works notified; the details, municipality by municipality, are in the permits and property-tax guide.

What taxes do you pay on a new pool: VAT and IMI?

Pool construction in Portugal pays the standard 23 % VAT (IVA): the tax authority has confirmed that the reduced 6 % rate for home building works excludes pools (binding ruling PIV 28005). Once built, the pool adds 0.06 to the IMI quality-and-comfort coefficient — about €40–€60 more property tax a year on a typical villa.

How do you manage a pool build from abroad?

On a Pools Portugal Network project, a non-resident owner follows the build through weekly reports with photos, video calls for the important decisions and a payment schedule tied to completed stages, with one point of contact in English or Portuguese. Nothing on site depends on the owner being in Portugal.

  • Weekly photo reports. Every stage — excavation, structure, waterproofing, finish, equipment — is photographed and sent to you.
  • Video calls for decisions. Choosing the finish colour, approving the plant-room position, checking the coping before it is laid.
  • Staged payments. Each payment is linked to a completed stage of the works, never to the calendar alone.
  • Paying in euros. Quotes, staged payments and VAT are in euros. If your income is in pounds or dollars, exchange-rate movements between the quote and the last payment change what the pool costs you — plan for that; we do not give currency advice.
  • Insurance. Tell your home insurer about the pool once it is built: it changes the insured value and your liability cover.

When should you start to swim by summer?

To swim by summer, ask for quotes between September and January and start the build by March. A concrete pool takes 8–12 weeks on site, plus 3–6 weeks for the project study, design and prior notice; a build that starts in May rarely finishes in time. Builders also have more availability outside the high season.

In protected areas — listed heritage, REN or RAN land, natural parks — a licence may be required and the câmara stage takes longer. A fibreglass pool goes in within days once the dig is done; an infinity pool needs more design time.

Are there special pool rules for holiday lets (Alojamento Local)?

Portugal has no national law requiring fences around private or holiday-rental (Alojamento Local) pools — the consumer association DECO has flagged this gap. Some municipalities do set rules: Óbidos requires pools to be safe, notably in terms of fencing and access to the water. With guests and children, a fence or safety cover is always advisable.

If you let the property, tell your insurer that it has a pool and check that your liability cover includes guests using it. An automatic safety cover also reduces evaporation and heat loss between stays. If you are buying a property with an existing pool to let, check that the pool was built legally: see our guide to buying a property with a pool.

Can water restrictions stop you filling a new pool?

There is no region-wide ban on filling pools around Lisbon or the Silver Coast, but municipalities can restrict it during supply alerts. In July 2026, the Câmara Municipal de Almada declared an alert and banned filling pools, watering gardens and washing cars because of water shortages. Plan the first fill outside heatwaves.

An 8 × 4 m pool with an average depth of 1.4 m holds about 45,000 litres. Our team schedules the first fill as part of start-up and checks notices from the local water utility before it begins.

Who looks after the pool while you are away?

After the build, the Pools Portugal team — the same team that does the start-up — takes over maintenance with regular visits, so the water stays balanced and the equipment is checked while you are abroad. Maintenance plans around Lisbon and the Silver Coast are listed on the pricing page.

Frequently asked questions

Can a foreigner build a pool in Portugal?

Yes. Nationality makes no difference: the owner of the property files a prior notice to the câmara, usually through an architect with a power of attorney, and needs a Portuguese tax number (NIF) to pay the fees and declare the pool for IMI.

Do I need a fiscal representative in Portugal?

Since Decree-Law 44/2022, non-residents who sign up to the tax authority's electronic notifications do not have to appoint one. The gov.pt guide still lists a representative when applying for a NIF as a non-resident, so confirm with Finanças.

Do I need to be in Portugal while the pool is built?

No. With a power of attorney, the responsible technician handles the câmara, and on a Pools Portugal Network project you follow the build through weekly photo reports and video calls, with payments tied to completed stages.

What VAT do I pay on a pool in Portugal?

The standard 23 % rate. The reduced 6 % rate for home building works expressly excludes pools, as the tax authority confirmed in binding ruling PIV 28005. Always check whether a quote includes VAT.

When should I start so the pool is ready for summer?

Ask for quotes between September and January and start building by March. A concrete pool takes 8–12 weeks on site, plus 3–6 weeks for the study, design and prior notice.

Do holiday-rental pools in Portugal need a fence?

There is no national law requiring fences around private or Alojamento Local pools, but some municipal regulations, such as Óbidos, require safe access to the water. A fence or safety cover is always advisable with guests and children.
