Terms of Service

Pools Portugal

Effective March 2026 — Portuguese law applies

1. Acceptance

By accessing or using the Pools Portugal website or platform (poolsportugal.pt), you agree to these Terms of Service. If you are a consumer, these Terms respect Portuguese consumer legislation.

2. Our Role

Pools Portugal, operated by PARATEC UNIP LDA, is an online intermediary platform that connects pool owners (“Clients”) with independent service providers (“Subcontractors”) for pool-related services, including cleaning, maintenance, opening/closing, repairs, and emergency services.

We act solely as a middleman and do not provide any pool services ourselves. Any contract for actual services is formed directly and exclusively between the Client and the Subcontractor. We are not a party to that contract.

3. Platform Use

  • Clients may browse services, request quotes, and create accounts to book Subcontractors.
  • Subcontractors may create accounts to offer their services and respond to requests.
  • Upon booking confirmation, the parties will enter into separate specific agreements (Client-Subcontractor contract and work order) through their respective logged-in accounts.
  • These Terms of Service apply only to the use of the platform itself.

4. No Liability for Services

To the maximum extent permitted by Portuguese law (including the Civil Code and consumer protection rules):

  • We provide no guarantees or warranties regarding the quality, safety, timeliness, legality, or outcome of any services performed by Subcontractors.
  • We are not liable for any damages, losses, injuries, property damage, delays, or claims arising from or related to the services provided by Subcontractors.
  • Our total liability to any user is limited to the amount of platform fees actually paid by that user for the relevant transaction.
  • Users release Pools Portugal from all claims connected with Subcontractor services.

Nothing in these Terms excludes liability where Portuguese or EU law prohibits such exclusion (e.g., our own gross negligence or wilful misconduct).

5. User Responsibilities

  • Clients must provide accurate information about their pool and ensure safe access for service providers.
  • Subcontractors must maintain valid public liability insurance, comply with all Portuguese regulations, and perform services professionally.
  • All users are responsible for verifying the credentials and insurance of the other party.
  • Any disputes regarding the actual services must be resolved directly between Client and Subcontractor.

6. Payments and Fees

Pools Portugal may charge a platform commission, which is clearly displayed before any booking. We act only as a payment facilitator. Refund and cancellation policies for services are governed by the specific agreements between Client and Subcontractor.

7. Intellectual Property

All content, logos, and platform features are the property of Pools Portugal or its licensors. You may not copy or use them without permission.

8. Termination

We may suspend or terminate your access to the platform for breach of these Terms, illegal conduct, or repeated complaints.

9. Governing Law

These Terms are governed by the laws of Portugal. Disputes shall be submitted to the courts of Lisbon, without prejudice to consumer rights to use alternative dispute resolution.

10. Changes to Terms

We may update these Terms. Continued use of the platform after changes constitutes acceptance.

Important Notice: These Terms apply only to the use of our intermediary platform. Separate contracts will govern the relationship between Clients and Subcontractors and any specific work orders. We strongly recommend that you review all agreements carefully and verify Subcontractor qualifications and insurance independently. This document does not constitute legal advice.
